Privacy policy

This policy explains what personal information FINTechNC (doing business as FinTech, "FinTech", "we", "us", or "our") collects through fintechnc.com and in the course of providing website design, hosting, and property walkthrough services, why we collect it, how long we keep it, who we share it with, and the choices and rights available to you. It applies wherever you are in the United States, since we serve clients nationwide.

1. Who we are

FINTechNC ("FinTech", short for Future Is Now Technologies) is based in Wilmington, North Carolina, and provides website design, website hosting, and interior property walkthroughs to clients throughout the United States. For any question about this policy or about personal information we hold, contact austin@fintechnc.com.

2. Scope

This policy covers fintechnc.com and the services we deliver in connection with it: the contact form, the free sample homepage offer, website design and build engagements, hosting plans, and property walkthroughs. It does not cover third-party websites we may link to, or services you use independently of us, such as your own bank or payment card issuer.

3. Information we collect

Information you give us directly. When you use the contact form, we collect your name, your email address, the topic you selected, and the message you write. If a project moves forward, we additionally collect what the engagement requires: business details, the text, images, logos and other content you supply for a website or a free sample homepage, and, for a walkthrough, the property address and any access instructions you provide.

Content you submit for a deliverable. If you provide photos, video, floor plans, written copy, or other material for a website, a free sample homepage, or a walkthrough, we process that material — including, in some cases, with the help of automated and AI-based tools — as part of preparing the deliverable you requested. We use submitted material only to produce your deliverable and for the recordkeeping described in this policy, not to train third-party models or for any purpose unrelated to your project.

Payment information. Payment is collected in full before delivery, as described in our terms of service and refund policy. Card and payment details are handled by our payment processor, [name the payment processor once selected, e.g. Stripe]; we do not store full card numbers on our own systems.

Your cookie banner choice. If you answer the cookie banner, that single choice is stored in your browser's localStorage, not as a cookie, and is not transmitted to us. Details are in the cookie policy.

Server logs. Our hosting infrastructure provider, Cloudflare, automatically records standard request information — IP address, the page requested, browser type, and the time of the request — for every visit, as is standard for essentially all websites. This is used for security, abuse prevention, and keeping the site running, and is retained under Cloudflare's own schedule as our infrastructure provider.

4. How we use information

We use the information described above to: respond to enquiries and provide the free sample homepage; design, build, and deliver website and walkthrough projects; process payment; provide and bill for hosting; maintain the records required for tax and accounting purposes; secure the site and prevent abuse; and, only where you have opted in, send occasional marketing email. We do not use personal information to make advertising profiles, and we do not sell personal information.

5. Legal bases for processing

Where a legal basis is required, we rely on: your consent (for the contact form and for marketing email); the need to perform a contract with you (for website, hosting, and walkthrough engagements); our legitimate interest in responding to enquiries and operating a functioning business website securely; and legal obligations that require us to keep certain financial records.

6. How long we keep information

• Enquiries that do not become a paid engagement: kept for [24 months], then deleted.
• Client and project records, including invoices: kept for [7 years] to satisfy tax and accounting obligations, then deleted.
• Marketing consent: kept until you unsubscribe, along with a record that you did, so we don't email you again by mistake.
• Content submitted for a walkthrough or website deliverable: kept for as long as reasonably needed to deliver and support the project, then deleted or returned on request.

7. Marketing email

We only send marketing email if you ticked the optional box on the contact form or otherwise opted in. Every marketing email includes a working one-click unsubscribe link, and we act on an unsubscribe request within [10] days. Unsubscribing from marketing email has no effect on transactional messages about a project you've purchased.

8. Your rights, and how to exercise them

Depending on where you live, you may have the right to ask us to: confirm what personal information we hold about you and provide a copy of it; correct inaccurate information; delete information we hold about you; restrict or object to certain processing; and withdraw a consent you previously gave. We apply these rights to everyone who asks, regardless of state of residence, as a matter of practice rather than only where strictly required.

To exercise any of these, email austin@fintechnc.com with "Data request" in the subject line and tell us what you'd like. We will confirm receipt within [3] business days and complete the request within [30] days. There is no charge. We may ask you to verify your identity before acting on a request, to avoid disclosing information to the wrong person. Where we are required by law to keep certain records — a paid invoice, for example — we will tell you what we're retaining and why, and delete the rest.

9. Children

Our services are directed at businesses and adults, and no part of fintechnc.com is directed at children. We do not knowingly collect personal information from anyone under 16. If you are under 16, please have a parent or guardian contact us on your behalf. If we learn that we have collected information from a child without appropriate consent, we will delete it. Anyone who believes a child's information has been submitted to us should contact austin@fintechnc.com.

10. Who we share information with

We do not sell personal information, and we do not share it with anyone for their own independent marketing purposes. We do share limited information with the service providers that let us run the business, each bound to use it only to provide their service to us:

• Cloudflare — hosting, content delivery, and network security.
• [payment processor] — payment processing for upfront project and hosting payments.
• [email provider] — sending and receiving business email.
• [accounting software] — invoicing and bookkeeping.

We may also disclose information where required by law, subpoena, or valid legal process, to protect the rights, property, or safety of FINTechNC or others, or in connection with a sale or transfer of the business, in which case this policy would continue to apply to the information transferred.

11. Where information is processed

We operate in the United States and our service providers listed above operate in or serve the United States. We do not intentionally transfer personal information outside the United States except as may occur incidentally through the ordinary operation of a service provider's own infrastructure.

12. Automated processing

As described in Section 3, we use automated tools, including AI-based tools, to help prepare certain deliverables from content you submit. We do not use automated tools to make decisions about you — such as pricing, eligibility, or whether to accept your business — that would produce legal or similarly significant effects without a person's involvement.

13. Security

The site is served over HTTPS. Business email and financial accounts are protected with multi-factor authentication where available. Payment card data is handled by our payment processor and does not pass through our own servers in full. No method of transmission or storage is completely secure, and we cannot guarantee absolute security; if an incident occurs that affects your information, we will notify affected individuals as required by applicable law.

14. Do Not Track

Because this site does not use tracking cookies or cross-site tracking technology in the first place, it does not respond differently to a browser's "Do Not Track" signal — there is no tracking to turn off.

15. Third-party links

Where this site or our correspondence links to a third party — our hosting provider's own site, for instance — that third party's privacy practices govern your interaction with them, and this policy does not apply to their sites or services.

16. Changes to this policy

We may update this policy from time to time, for instance as our services or applicable law change. The version posted at fintechnc.com/legal/privacy is the current one, and the date at the bottom of this page reflects the last revision. Material changes affecting an active hosting client will be sent by email.

17. Disclaimer and limitation of liability

This section covers our handling of personal information specifically; the complete disclaimer of warranties and limitation of liability governing our services generally is set out in the terms of service, and is incorporated into this policy by reference.

We take reasonable measures to protect personal information, but to the maximum extent permitted by applicable law, FINTechNC disclaims liability for unauthorized access to or use of our servers or any personal information stored on them that results from causes beyond our reasonable control, including the acts of third-party infrastructure providers such as Cloudflare. Nothing in this section limits any right or remedy that cannot be limited or excluded as a matter of law.

18. Governing law

This policy is governed by the laws of the State of North Carolina, consistent with the terms of service, without regard to its conflict-of-law principles.

Terms of service

These terms govern the website design, hosting, free sample homepage, and property walkthrough services provided by FINTechNC, doing business as FinTech, to any client in the United States. By requesting a free sample homepage, accepting a quote, or paying for a service, you agree to these terms.

1. Who you're contracting with

FINTechNC ("FinTech", "we", "us"), based in Wilmington, North Carolina. Contact: austin@fintechnc.com. Registered business address: [street, city, NC, ZIP].

2. Services

We provide, on the terms below: (a) website design and build; (b) website hosting, billed monthly or yearly; (c) a free sample homepage, offered without charge as described in Section 3; and (d) interior property walkthroughs, billed at a flat rate. Each is a distinct service and may be purchased independently.

3. The free sample homepage

We will design one sample homepage per business at no charge, based on information you provide. The sample is a design concept only — it is not a hosted, live website, and no further obligation is created by requesting or receiving it. We may decline to provide a sample, or may limit the scope of a sample, at our discretion, including where a request appears abusive, duplicative, or made in bad faith.

4. Quotes, pricing, and payment

Website design ranges from $650 to $12,000, priced to the scope of the project following the free sample stage; we do not cap the number of pages, and scope — not page count alone — is what moves the price within that range. A written quote is provided before work begins and is valid for 30 days. Hosting is billed monthly or yearly at a rate set out at the time you sign up, and is optional. Property walkthroughs are a flat $125 per property, interior only, anywhere in the United States.

Payment is collected in full, upfront, before delivery, for website design and for walkthroughs. Hosting is billed in advance for each billing period. We do not offer installment or milestone billing unless we agree to it with you in writing.

All sales are final. Refunds, cancellations, and the limited exceptions that apply are governed entirely by the refund policy, which is incorporated into these terms.

5. Turnaround times

Any turnaround time we state — including "about a week" for a website or "next business day" for a walkthrough — is an estimate, not a guaranteed delivery date. We may take up to seven additional days beyond any stated or estimated turnaround time to deliver a project, without that delay constituting a breach of these terms, a basis for a refund, or a basis for any penalty or additional liability on our part.

6. Ownership of deliverables

Once a website project is paid in full, you own the resulting design, source code, and content, and may use, modify, host, or move it as you choose. We retain ownership of our own general-purpose tools, components, and code that predate or are reused across client projects, and grant you a permanent license to use them as delivered to you as part of your project.

Walkthrough deliverables (video and photos) are owned by you once payment is complete, for use in connection with the marketing and sale of the relevant property.

Third-party material incorporated into a deliverable at your request or by necessity (fonts, stock assets, plugins) remains owned by its respective owner and is licensed to you under that owner's terms, named in your quote where applicable.

7. The domain, where hosting is purchased

If you purchase hosting from us, in whole or as a bundle with a website build, FINTechNC registers the domain associated with the site and holds ownership of that domain registration for as long as the hosting plan remains active. This arrangement exists to keep hosting, DNS, and certificate management working smoothly while we host the site for you; it does not affect your ownership of the design, code, or content, which are governed by Section 6.

You may purchase the domain outright and have it transferred into your own name at any time during an active hosting plan, at our then-current domain transfer price. Clients who bundle hosting with a new website purchase receive a [10%] discount on the website design fee, applied at the time of purchase.

If a hosting plan ends and the domain has not been purchased by the client, we will offer the client the opportunity to purchase and transfer the domain before taking any other action with respect to it. This section applies only to domains registered by us in connection with a hosting plan; it does not apply to domains you already owned before working with us or registered yourself.

8. Client content, copyright, and other legal compliance

You are solely responsible for the legality of everything you provide to us for use in a website, a free sample homepage, or a walkthrough — including text, images, logos, trademarks, and, for a walkthrough, the right to have the property photographed and to have that material published and used for marketing. You represent that you own or have the necessary rights and licenses for all such content, and that your use of it, and our use of it at your direction, does not infringe any third party's copyright, trademark, privacy, or other right.

You agree to indemnify, defend, and hold harmless FINTechNC, its owner, and its contractors from and against any claim, demand, loss, liability, or expense (including reasonable attorneys' fees) arising out of or related to: content you provided; your use of a deliverable; your breach of these terms; or your violation of any law or of a third party's rights. This obligation survives the end of your engagement with us.

9. Acceptable use

We may decline to build, host, or continue hosting anything that is illegal, infringing, fraudulent, or that we reasonably believe exposes FINTechNC to legal or reputational risk. Where we decline or discontinue service on this basis after payment, the refund policy governs whether any amount is returned.

10. Hosting infrastructure and third-party services

Hosting is provided using Cloudflare's infrastructure. Outages, latency, security incidents, or other issues arising from Cloudflare's network or services — or from any other third-party infrastructure, registrar, or payment processor we rely on — are the responsibility of that provider, not FINTechNC, and FINTechNC is not liable for any resulting loss or damage, to the maximum extent permitted by applicable law. We are similarly not responsible for delay or failure caused by circumstances beyond our reasonable control (force majeure), including outages, natural disasters, internet service disruptions, or acts of government.

11. No warranty

Services are provided on an "as is" and "as available" basis. To the maximum extent permitted by applicable law, FINTechNC disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that a website or hosting will be uninterrupted, error-free, or completely secure, and we do not warrant any particular business result — including sales, leads, traffic, or search ranking — from a website, a sample homepage, or a walkthrough.

12. Limitation of liability

To the maximum extent permitted by applicable law: FINTechNC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost revenue, lost data, or business interruption, arising out of or relating to these terms or the services, even if advised of the possibility of such damages. FINTechNC's total liability arising out of or relating to these terms or the services will not exceed the amount you actually paid to FINTechNC for the specific service giving rise to the claim in the twelve (12) months before the event giving rise to the claim.

Nothing in these terms excludes or limits any liability that cannot be excluded or limited as a matter of law, including liability for death or personal injury caused by negligence, or for fraud.

13. Termination

You may stop using our services at any time; amounts already paid are handled under the refund policy. We may suspend or end a hosting plan for non-payment, or end any engagement for a violation of Section 8 or 9, on notice where practicable. Sections 6 through 8, and 11 through 16, survive the end of any engagement.

14. Changes to these terms

We may update these terms from time to time. The version posted at fintechnc.com/legal/terms governs new engagements from the date it is posted; for an active hosting client, we will give at least [30] days' notice by email before a material change takes effect.

15. Entire agreement; severability; no waiver

These terms, together with your written quote and the linked refund policy and privacy policy, form the entire agreement between you and FINTechNC regarding the services, and supersede any prior discussion. If any provision of these terms is found unenforceable, the remaining provisions continue in full force, and the unenforceable provision will be interpreted to best reflect its original intent within the limits of applicable law. Our failure to enforce a provision is not a waiver of our right to do so later.

16. Governing law and venue

These terms are governed by the laws of the State of North Carolina, without regard to its conflict-of-law principles, regardless of your state of residence. Any dispute not otherwise resolved will be brought in the state or federal courts located in North Carolina, and you consent to jurisdiction there.

Refund policy

All sales are final. Payment is collected in full before we deliver, and we do not offer refunds once a payment has been made — including on hosting and other subscription plans — except where applicable law requires otherwise.

1. All sales are final

Website design, free sample homepages, hosting, and property walkthroughs are all sold on a final-sale basis. This applies equally to one-time project fees and to recurring hosting charges: cancelling a subscription stops future billing, but does not refund amounts already paid, including the payment for the billing period in progress at the time of cancellation.

2. Payment is collected upfront

For website design and property walkthroughs, full payment is due before we begin or deliver the work. For hosting, each billing period is paid in advance. We do not extend credit or begin project work before payment is received.

3. The free sample homepage is not a purchase

Because the sample homepage described in the terms of service is provided at no charge, this refund policy does not apply to it — there is nothing to refund. Declining to proceed after seeing a sample carries no cost or obligation.

4. Cancelling a hosting plan

You may cancel a hosting plan at any time. Cancellation stops the plan from renewing at the end of the current billing period; it does not refund the current or any prior period. You will receive your website files and may move them to another host, subject to the domain terms in Section 7 of the terms of service.

5. If delivered work materially fails to match the quote

If what we deliver materially fails to match the scope set out in your written quote, contact us within [14] days of delivery and we will correct it at no additional charge. Outside of any remedy required by applicable law, correction — not a cash refund — is the remedy we offer, and providing it is at our discretion once the correction has been made.

6. Exceptions required by law

Some states and circumstances provide rights that cannot be waived by contract — for example, in connection with goods or services not delivered at all, or certain payment-method protections through your bank or card issuer. Nothing in this policy limits a right of that kind. Where applicable law requires a refund we have not otherwise provided, we will comply with that law.

7. Chargebacks

If you have a concern about a charge, please contact us first at austin@fintechnc.com — most issues are faster to resolve directly than through a card dispute.

8. Governing law

This policy is governed by the laws of the State of North Carolina and is incorporated into the terms of service, which contains the full limitation of liability applicable to all services, including this policy.

Cookie policy

This policy explains what fintechnc.com stores in your browser and why. In short: no advertising or tracking cookies, and no third-party scripts — the only thing stored is your own answer to the cookie banner.

1. What a cookie is

A cookie is a small piece of data a website asks your browser to store and send back on later visits, typically used to remember who you are or to track activity across sites. Related technologies include localStorage (data a site can store in your browser that isn't automatically sent back to the server the way a cookie is) and tracking pixels (small embedded images used to log that a page was viewed, often by a third party).

2. What this site stores

fin.consent.v1 — strictly necessary, first-party

Stored using localStorage, not as a cookie. It records one value: whether you accepted or declined optional analytics. It is read only by this site, is never transmitted to our server, and persists until you clear your browser's site data. Without it, the cookie banner would reappear on every page.

Optional analytics — off unless you accept

Nothing is loaded by default. If we enable analytics in the future, it will be a cookieless, privacy-preserving product, it will load only after you choose "Accept analytics," and this section will be updated to name it before it goes live.

3. What this site does not use

No advertising cookies, no cross-site tracking pixels, no third-party embeds (video players, social buttons, chat widgets, map embeds), and no third-party fonts or scripts of any kind. Every file the site loads is served from fintechnc.com itself. If that ever changes, this page changes with it, and the cookie banner will govern anything that requires consent.

4. Server logs

Separately from cookies, our hosting infrastructure provider, Cloudflare, records standard connection information (such as IP address and request timestamp) for security and reliability, as described in the privacy policy. This is not a cookie and is not something a browser setting can turn off.

5. Payment processing

If you make a payment through the site, our payment processor may set its own cookies or use its own local storage as part of securely handling that transaction. That is governed by the payment processor's own policy, not this one, and is limited to the payment flow itself.

6. Changing your choice

Use the "Cookie settings" link in the footer of any page to reopen the banner and change your answer at any time. You can also clear stored site data through your browser's own settings, which will make the banner appear again on your next visit. Declining has no effect on any part of the site — everything works the same either way.

7. Changes to this policy

We may update this policy if what the site stores changes. The version posted at fintechnc.com/legal/cookies is the current one.

Accessibility statement

We build fintechnc.com, and the sites we design for clients, to WCAG 2.2 level AA. This page says what's actually been checked here, and where we know it falls short.

What we've done on this site

• Every page works with a keyboard alone, with a visible focus outline throughout.
• A "skip to content" link is the first stop on every page.
• Text colors were checked against their backgrounds: body text is at least 4.5:1 and large text at least 3:1. The light blue accent is decorative only and is never used for text you need to read or a control you need to operate.
• Images that carry meaning have real alt text; decorative images are hidden from screen readers instead of being described.
• Form fields have visible labels, errors are announced to assistive technology, and no error relies on color alone.
• Motion respects prefers-reduced-motion: the hero animation and the scroll transitions used throughout the site are removed for anyone whose system requests reduced motion, and content is shown immediately rather than withheld.
• Headings run in a logical order and landmarks are marked up so the page can be navigated by section.

What we haven't verified

• A full screen-reader pass with [NVDA / JAWS / VoiceOver] has not yet been completed.
• Client sites that embed third-party tools outside our control may not meet the same standard.

Tell us if something doesn't work

If you hit a barrier on this site, email austin@fintechnc.com with the page address and what happened. We aim to acknowledge within [2] business days and tell you what we plan to do about it.

On client work

Every website we build gets an accessibility pass before launch, included in the quoted price rather than sold as an add-on. If something a client asks for would make a site harder to use, we'll say so and suggest a way to get the same effect without that cost.
